1. Introduction

Welcome to Plot Share UK! We are a platform that connects individuals with available space such as gardens, allotments, driveways, and garages ("Owners") with individuals who wish to use that space ("Renters").

These Terms of Service ("Terms") govern your use of the Plot Share UK website, its features, and services (collectively, the "Platform"). By creating an account or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Platform.

2. Definition of Key Terms

User: Any individual who registers an account on the Platform, including Owners and Renters.

Owner: A User who lists a garden, allotment, driveway, garage, or other space ("Space") for use by a Renter.

Renter: A User who enters into an agreement with an Owner to use their Space.

Space: The specific area of property, including any agreed-upon facilities (e.g., water access, EV charger), made available by an Owner.

Rental Agreement: An arrangement where a Renter pays a fee to an Owner for the use of a Space.

3. Description of Services

Plot Share UK provides a neutral online platform for Owners to list their available Spaces and for Renters to find and book them. Our services include hosting listings, facilitating communication via our messaging system, and processing payments on behalf of our users.

4. Plot Share UK's Role & Limitation of Liability

Plot Share UK is a Neutral Venue: You acknowledge that Plot Share UK is a neutral platform that connects Owners and Renters. We are not a real estate broker, agent, or insurer. Plot Share UK is not a party to any rental agreement or transaction made between users. We do not own, manage, inspect, or endorse any of the properties listed on our platform.

User Responsibility: Users are solely responsible for their interactions with other users. You agree to take reasonable precautions in all communications and interactions.

Limitation of Liability: To the fullest extent permitted by law, Plot Share UK and its affiliates shall not be liable for any damages, including but not limited to, property damage, theft, personal injury, financial loss, or any other dispute arising from an agreement or interaction between users of the platform. All transactions are entered into at the users' own risk.

5. Fees and Payments

Listing a space on Plot Share UK is free for Owners. Our revenue comes from service fees applied to successful bookings.

  • Fees for Owners: For each completed booking, a 5% commission fee will be deducted from the payout to the Owner. The payout an Owner receives will be 95% of their listed price.
  • Fees for Renters: The price shown on a listing is the amount set by the Owner. At checkout, a 15% service fee will be added to the booking price. The total price will be clearly displayed to the Renter before they confirm payment.

Payment Processing: All payments are handled by our secure third-party payment processor (Stripe). By making or receiving payments on the Platform, you agree to abide by the processor's terms and conditions.

Taxes: Users are solely responsible for determining their own tax reporting requirements and for remitting any applicable taxes to the relevant authorities.

6. User Accounts & Responsibilities

  • Eligibility: You must be at least 18 years of age and a resident of the United Kingdom to create an account.
  • Accuracy: You agree to provide accurate, current, and complete information during the registration process and to keep it updated.
  • Account Security: You are responsible for safeguarding your password and for all activities that occur under your account.

7. Code of Conduct

All Users agree to communicate respectfully and to provide truthful and accurate information in their profiles, listings, and messages. You agree to comply with all local laws and regulations.

8. Specific Terms for Owners

As an Owner, you agree to create listings that are accurate and not misleading. You must ensure you have the legal right to offer the Space for use and maintain a safe environment for any Renter accessing your property.

9. Specific Terms for Renters

As a Renter, you agree to use the Space solely for the purpose agreed upon with the Owner and to maintain the Space in a tidy and responsible manner, respecting the Owner's property.

10. Intellectual Property

All content on the Platform, including the Plot Share UK name, logo, and website design, are the exclusive property of Plot Share UK and are protected by copyright laws.

11. Termination

You may terminate your account at any time. Plot Share UK reserves the right to suspend or terminate your account if you violate these Terms.

12. Dispute Resolution

We encourage Users to resolve disputes between themselves amicably. Plot Share UK is not obligated to mediate disputes. Any legal claim arising out of these Terms shall be resolved by the courts of England and Wales.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
